1 Introduction & Identity
These general conditions apply to any order of products on the website of the company Bold Baguette (Sunny Lemon V.O.F.), registered with the register of legal entities under number 0795353775 (VAT BE0795.353.775), located in Rombaut Keldermansstraat 25, 2650 Edegem, Belgium.

Any order for a product of the website www.boldbaguette.com, implies acceptance of all these terms and conditions. As a result, the client is fully aware of the fact that his agreement on the content of these conditions does not require the signature of this document, as far as the customer wishes to order online the products presented in the framework of the shop website.
2 General conditions
The customer could save or print these general conditions, given that both, backup or editing
this document are his full responsibility. Bold Baguette may change these terms and conditions at any time on its website. However, current contracts are applicable to the conditions at the time of the conclusion of the sale. It is therefore advised to refer regularly to the latest version of the terms and conditions permanently available on the website.
CONSUMER, means any physical or legal person who acquires or uses for an nonprofessional purpose, products or services presented on the website. As a consumer, the customer has specific rights, which would be denied in the occurence that the products or services acquired through the website would actually concerned to his professional activity.
PROFESSIONAL means anyone who does not fit the definition of consumer given above.
3 Online sales conditions
The product catalogue and description on www.boldbaguette.com do not constitute an offer in its current form. It is not sufficient to fill out an order form on the website to have a contract. The sale will be definitively concluded only at the receipt of the confirmation email. For security and customer confidence, Bold Baguette reserves the right to request additional information and to refuse the order if Bold Baguette believes to have insufficient information in its possession. Bold Baguette may also refuse orders if it appears that the buyer wants to resell the products.
4 Order confirmation
The contractual information will be confirmed by email before the delivery.
Bold Baguette answers your order if stocks are available. Delivery time is 2-3 working days for Benelux countries, 2-5 working days for France, Germany, Great Britain, Austria, Czech Republic, Denmark, Finland, Greece, Hungary, Ireland, Italy, Portugal, Spain and Sweden, excepting exceptional circumstances (weather, strikes, traffic problems, etc.). However, if, despite its vigilance, products are unavailable after your order, Bold Baguette will notify you by email and invite you to cancel or change your order.
Product availability is always indicated on our website. A product indicated 'in stock' is available immediately. However, Bold Baguette can not be responsible if the stock is not the same at the date of the order. Any unavailability is generally noted on the website. If Bold Baguette cannot get a product from its suppliers within a reasonable time (eg in case of unavailability at the supplier itself), it will notify the Customer of the expected delay by email. Then the Customer can choose to cancel or exchange its order, based on the new stock information. No penalties will be applied for such an order cancellation. Bold Baguette reserves the right to send the order in two or more parcels if a product was unavailable. This shipment won't be additionally charged to the Customer (he will only pay the shipping fees indicated in the order).
7 Ownership transfer
According to Article 1583 of the Civil Code, sold or delivered goods remain the exclusive property of Bold Baguette until full payment of the order. All risk of loss and damage relating to the goods concerned are to the customer as soon as the order is placed.
Purchased items travel at risk of the buyer. If the customer opts for a secured shipping, Bold Baguette bears the cost of any damage (theft, damage, missing objects) caused to the product and refund in this case shipping costs.
All products' prices are indicated in euros all taxes included, excluding shipping costs. The shipping costs are paid by the customer (unless special conditions apply as indicated on the website).
Bold Baguette reserves the right to change prices at any time. However, Bold Baguette has to apply the prices displayed at the time of your order.
Payment of the full price must be operated at the time of your order. Payments can not be considered as a deposit or deposits. All orders are payable in EURO.
Bold Baguette accepts several methods of payment:
- Online banking (i.e. Bancontact, iDEAL)
- Credit cards (i.e. VISA, MasterCard)
You ensure Bold Baguette to having all the necessary authorizations to use the payment method chosen during registration of the command. Bold Baguette reserves the right to suspend or cancel any order and/or delivery, of all nature and at all level of execution in case of non-payment (or payment incident). The delivery of any new order may be suspended in case of late payment for a previous order. Bold Baguette reserves the right to request a copy of identity card and/or a bank receipt for any payment by credit card.
10.1. - Generalities
Products purchased on Bold Baguette are delivered only in the countries listed on the website. They will be delivered to the address indicated on the order form. Bold Baguette cannot be held responsible for the consequences due to a shipping delay related to the responsibility of BPost. There will be no refund of the order before it is returned to Bold Baguette.
If you decide to cancel your order after payment and your order is already out for delivery,
Bold Baguette will provide a refund of the product at its full reception. It is strongly advised
to return the product in its original state.
10.2. – Risk transfer
The property and the risks associated with your products will be transferred upon receipt of the products.
10.3. - Custom duty
When your ordered products are delivered to a country other than Belgium, you are considered as the authorized importer and as such you must respect the laws and regulations of the country in which you take delivery of the goods. You may be subject to fees or duties to the arrival of the goods in your country. All additional customs' fees are your own responsibility. Bold Baguette has no control over these charges and does not know the amount. Customs policies vary by country, you should contact your local customs' department for more information.
10.4 – Delivery problems
Any remark about the products delivered (i.e. damaged package, already opened ...) must be notified to Bold Baguette within 3 days of products' receipt. Any problem regarding the items in the parcel (article outdated, missing, not corresponding to the ordered ...) must be notified to Bold Baguette within 14 days of receipt. Any issue after this period will not longer be at the responsibility of Bold Baguette and the product will not be refunded or replaced.
10.5 - Product conformity
Bold Baguette will refund or exchange products that do not correspond to your order. If this is the case, we would like to ask you to report this in details by firstly sending us an email (firstname.lastname@example.org) and secondly returning the products (at own cost) to Bold Baguette. Bold Baguette will, at your convenience, exchange or refund the product. The request must be made within 14 calendar days after delivery. Any claim made after this deadline will not be accepted.
It is strongly advised to return products to Bold Baguette in the same condition you have received them.
10.6 - Parcel
If the customer is not present during the delivery of the parcel and doesn't withdraw his/her package at the postal office within 15 days, the package is returned to Bold Baguette. If this is the case, Bold Baguette returns the package to the customer only when the package is received from BPost in return (or refunded by BPost if lost), and the shipping cost of the second shipment will be charged to the customer, and this, even if the Post hasn't left a delivery notice.
11 Conformity and Guarantee
11.1 The trader guarantees that the products and/or services fulfill the contract, the specifications stated in the offer, the reasonable requirements of reliability and/or serviceability and the statutory stipulations and/or government regulations that existed on the date that the contract was concluded.
11.2 A guarantee arrangement offered by the trader, manufacturer or importer does not affect the legal rights and claims that a consumer, as a result of the contract, can enforce against the trader.
12 Renunciation right
In accordance with the 6 April 2010 law, the consumer has the right to notify the seller that he renounces to his order without penalty and without giving any reason, within 14 calendar days from the day after the product delivery. It's strongly recommended that the returned products to Bold Baguette are in perfect condition for resale in their original condition, sealed, and with a copy of the invoice or delivery within 14 days. Any incomplete or damaged product, will not be refunded or exchanged.
Consumers wishing to exercise this right should contact Bold Baguette by email message within 14 calendar days.
13 Transaction proof
The records, stored in Bold Baguette computer systems under reasonable security conditions, are considered as a proof of communications, orders and payments between the parties. The filing of purchase orders and invoices is made on a reliable and durable support that can be used as evidence.
14 Responsability limits
14.1 Photos and texts illustrating the products on this site are not contractual and only for informational purposes. Bold Baguette is not responsible for any error or omission in photos or texts appearing on this site. Furthermore, on the technical specifications and product descriptions from our partners or suppliers, Bold Baguette accepts no responsibility for the validity of their content.
14.2 Without limiting these terms of sales, the non-delivery of goods may not exceed the amount of the purchase price of the products concerned by a request for damages and interests. Bold Baguette can't be liable for indirect, incidental or consequential damages of any kind (even if the origin of such damage was known or could have been known by Bold Baguette) arising in connection with its products, their use, sale or website.
15 Case of emergency
15.1 Bold Baguette will do whatever’s possible to fulfill its obligations but can't be held responsible for delays or failure to deliver caused by circumstances beyond its control, such as strikes, wars, natural or other disasters that prevent production, transportation or delivery of products.
15.2 In case of delay, Bold baguette will fulfill its obligations in the shortest time possible and reserves the right to fairly allocate the remaining stocks of products among its customers.
16 Data protection
By placing your order, you agree that Bold Baguette stores, processes and uses data collected from your order. Some of this information may be transferred to companies involved in the delivery of your products.
You can obtain a copy of the data held by us about you by sending a written request. If any data held by us concerning you is incorrect, it will be corrected upon written request from you.
